Consultation on Proposed New
Charitable Incorporated Organisations
The Charity Commission have just produced a guide to the Consultation Document on the new proposed Charitable Incorporated Organisations (CIO), which the Companies Act 2006 has foreshadowed. This has been produced in conjunction with The Office for the Third Sector (see below).
They ask for comments before 10th December 2008.

There are two draft forms of constitution: one where the Organisation has members (rather like the FFHS at present) and another where there are no members except the trustees(a foundation model). The guidance itself says that there is no need to comment upon or to read the whole documentation:
“……… the draft Regulations and Order are, by their nature, technical legal documents. You may find all the information you want in the Executive Summary and Background, or you may be more interested in reading about the model constitutions, how a CIO will function in practice and what powers and duties the trustees will have…...”
